The Indemnity Act, 1974

[21st November, 1974.]

Be it enacted by the President and Members of Parliament in this present Parliament assembled, as follows: —

1.(1) No action or other legal proceedings whatsoever shall be instituted in any Court of law for or on account of or in respect of any act, matter or thing done or omitted to be done whether within Sierra Leone or without during the period extending from the 13th day of August, 1974 to the 9th day of October, 1974 by any person acting under the authority of the President or a Minister if done in good faith and done or purported to be done in the execution of his duty or in the public interest; and if any such proceeding has been instituted whether before or after the commencement of this Act, it shall be discharged and made void:

Provided that the provisions of this section shall in no way affect the institution or prosecution of proceedings on behalf of the State or any Government Department or any proceedings instituted by way of Petition of Right.

(2) For the purpose of this Act a certificate by the Attorney-General that anything was done or omitted to be done by or under the authority of the President or a Minister or was done by any person in the execution of his duty, shall be sufficient evidence of the matter so certified; and anything done or omitted to be done by or under the authority of the President or a Minister shall be deemed to have been done in good faith unless the contrary is proved.
