TRIAL CHAMBER I (“Trial Chamber”) of the Special Court for Sierra Leone (“Special Court”) composed of Hon. Justice Bankole Thompson, Presiding Judge, Hon. Justice Pierre Boutet, and Hon. Justice Benjamin Mutanga Itoe;

MINDFUL of this Chamber’s Scheduling Order Concerning the Preparation and Commencement of the Defence Case issued on the 30th of October 2006 ordering, inter alia, each Defence Team to file by no later than the 16th of February 2007 various materials for the preparation and commencement of their defence case;

HAVING RECEIVED the Defence Application for Adjournment of the 16th of February 2007 Filing, filed publicly by Counsel for the First Accused, Issa Hassan Sesay, (“Defence”) on the 25th of January 2007, seeking an adjournment of the aforementioned filing date until the 5th of March 2007;

CONSIDERING that Article 17(4)(b) of the Statute of the Special Court (“Statute”) provides that the Accused shall be entitled to have “adequate time and facilities for the preparation of his defence”;

CONSIDERING that Article 17(4)(c) of the Statute provides that the Accused shall be entitled “to be tried without undue delay”;

FINDING that, in the circumstances, it would also be helpful to have written submissions from each of the Defence Teams in order to determine the merits of the Application;

CONSIDERING that the fair and expeditious consideration of the Application requires the imposition of an expedited timetable for the filing of any remaining written submissions;


PURSUANT TO Article 17 of the Statute and Rule 7(C), 26bis and 54 of the Rules;


HEREBY ORDERS as follows:

  1. Any Response to the Application by the Office of the Prosecutor, Defence Counsel for the Second Accused, Morris Kallon, and Court Appointed Counsel for the Third Accused, Augustine Gbao shall be filed no later than Monday, the 29th of January 2007 at 12:00 noon; and
  2. Any Reply by the Sesay Defence shall be filed no later than Wednesday, the 31st of January 2007 at 4:00pm.
