RECALLING the Order for Disclosure Pursuant to Rule 73ter and the Start of the Defence Case, made on 26 April 2006 (“Order”);

CONSIDERING that there has been no change in circumstances since the Order was made and that Defence Counsel have made commitments based on the Order;

FINDS that the Motion is accordingly without merit;

and

DISMISSES the Motion.
