TRIAL CHAMBER I (“The Chamber”) of the Special Court for Sierra Leone (“Special Court”) composed of Hon. Justice Bankole Thompson, Presiding Judge, Hon. Justice Pierre Boutet and Hon. Justice Benjamin Mutanga Itoe;


SEIZED OF the “Request for Extension of Time to Re-File Final Trial Brief”, filed on the 24th of November 2006 by Court Appointed Counsel for the Third Accused, Allieu Kondewa (“Counsel for Kondewa”);[1]


MINDFUL of The Chamber’s “Order for Filing Final Trial Briefs and Presenting Closing Arguments” of the 29th of September, 2006;[2]

NOTING that pursuant to the Order for Final Trial Briefs, Counsel for Kondewa filed the “Final Trial Brief of the Third Accused Allieu Kondewa” (“Kondewa Final Brief”) on the 22nd of November 2006;[3]

MINDFUL of The Chamber’s “Order on Re-Filing of Kondewa Final Trial Brief” of the 23rd of November, 2006 (“Order on Kondewa Re-Filing”);[4]

RECALLING The Chamber’s finding that the Kondewa Final Brief is not in compliance with The Chamber’s Order for Final Trial Briefs;[5]

CONSIDERING Counsel for Kondewa’s admission that the Kondewa Final Brief “fails to comply materially with paragraph 5 of The Chamber’s [Order for Final Trial Briefs]”;[6]

CONSIDERING Counsel for Kondewa’s submission that:

[A]t the present moment it is only one Counsel who is working on the case for the 3rd Accused, the other three Counsel being out of the jurisdiction on other matters and without any means of communicating with them.[7] [sic]

FINDING that in the present circumstances there exists good and sufficient cause or exceptional circumstances to grant an extension of time to allow Counsel for Kondewa to re-file the Kondewa Final Brief in accordance with The Chamber’s Order for Final Trial Briefs and the present Order;

PURSUANT to Rule 7bis and 54 of the Special Court Rules of Procedure and Evidence;

HEREBY ORDERS as follows:

  1. Court Appointed Counsel for the Third Accused shall re-file the Kondewa Final Brief and shall ensure that every reference to the testimony of witnesses is supported by the date and transcript page reference of the testimony in question, by 10.00 a.m. on the 27th of November, 2006.
