TRIAL CHAMBER I (“The Chamber”) of the Special Court for Sierra Leone (“Special Court”) composed of Hon. Justice Bankole Thompson, Presiding Judge, Hon. Justice Pierre Boutet and Hon. Justice Benjamin Mutanga Itoe;

SEIZED OF the “Prosecution Motion for Leave to Call Evidence in Rebuttal and for Immediate Protective Measures for Proposed Rebuttal Witness”, filed by the Office of the Prosecutor (“Prosecution”) on the 13th of October 2006 (“Motion”),[1] wherein the Prosecution seek leave of The Chamber to call one witness in rebuttal at the conclusion of the Defence case and, if it is granted, to request immediate protective measures for this proposed rebuttal witness;

NOTING that the Defence case for the Third Accused will likely close on the 18th of October 2006;[2]

CONSIDERING that Article 17(4)(c) of the Statute of the Special Court provides that the Accused shall be “tried without undue delay”;

CONSIDERING that the fair and expeditious consideration of the Motion requires the imposition of an expedited timetable for the filing of any remaining written submissions;[3]

PURSUANT to Rule 7(C), 26bis, 54 and 73 of the Rules of Procedure and Evidence of the Special Court;

HEREBY ORDERS as follows:

  1. Any Response to the Motion shall be filed no later than Monday, the 16th of October 2006, at 4:00 p.m.;
  2. Any Reply to the said Response shall be filed no later than Tuesday, the 17th of October 2006, at 4:00 p.m.;

AUTHORISES the Court Management Section of the Special Court to serve the present Order after 4:00 p.m., today the 13th of October 2006.
