TRIAL CHAMBER II (“Trial Chamber”) of the Special Court for Sierra Leone (“Special Court”), composed of Judge Teresa Doherty, presiding, Judge Richard Lussick and Judge Julia Sebutinde;

BEING SEISED of the Motion to Disclose Prosecution Materials and/ or Other Information Pertaining to Rewards Provided to the Prosecution Trial Witnesses (“the first Motion”), filed by Defence Counsel for the Accused Santigie Borbor Kanu on 4 March 2005;

BEING SEISED of a Motion in Support of the first Motion, filed by Defence Counsel for the Accused Alex Tamba Brima on 4 March 2005 (“the second Motion”);

HAVING HEARD the Parties in open Court on 16 March 2005;

NOTING the Combined Prosecution Response to the first and second Motion, filed on 7 March 2005 in which the Prosecution declares that it will disclose a record of payments made to its witnesses prior to the evidence in chief of each witness pursuant to Rule 68 of the Rules of Procedure and Evidence and it will endeavour to reach an agreement with Defence Counsel for the Accused as to the timing of such disclosure;

NOTING the Joint Reply on the Combined Prosecution Response, filed on 10 March 2005 in which the Defence no longer seeks a ruling on the motions and that they are satisfied that there is no issue between the parties in relation to this aspect of disclosure;

FOR THE ABOVE REASONS, THE TRIAL CHAMBER

DISMISSES BOTH MOTIONS.
