THE TRIAL CHAMBER (“Trial Chamber”) of the Special Court for Sierra Leone (“Special Court”) composed of Hon. Justice Benjamin Mutanga Itoe, Presiding Justice, Hon. Justice Bankole Thompson, and Hon. Justice Pierre Boutet;


NOTING the filing of the “Abuse of Process Motion by First Accused for Stay of Trial Proceedings” (“Motion”), by Court Appointed Counsel for the First Accused on the 3rd of February 2005;


NOTING that the Motion fails to comply with Article 4(G) of the Practice Direction on Filing Documents before the Special Court for Sierra Leone (“Practice Direction”), Adopted on the 27th of February, 2003 and Amended on the 1st of June, 2004, where Article 4(G) states:


The typeface shall be 12 point, “Times New Roman” font, with 1.5 line spacing. An average page shall contain a maximum of 300 words.


CONSIDERING that the Motion is a clear breach of Article 4(G) of the Practice Direction;


PURSUANT to Rule 54 of the Rules;


THE TRIAL CHAMBER THEREFORE:

FINDS that the Motion does not constitute a valid filing.
