Failure to record the judge's summing-up in a jury trial will not necessarily prove fatal, but where the appellate court cannot be sure that the jury have been properly directed and that, if properly directed, they would have brought in the same verdict, the conviction will be quashed (page 122, lines 26--31; page 123, lines 27-30, 34-39).
