The Telecommunications (Amendment) Act, 2007.

 

Being an Act to amend the Telecommunications Act, 2006.

Enacted by the President and Members of Parliament in this present Parliament assembled.

The Telecommunications Act, 2006 is hereby amended by the repeal and replacement of section 16 thereof bv the following section:-

16. (1) The activities of the Commission shall be financed by a fund consisting of-

(a) moneys appropriated by Parliament for the purposes of the Commission; and

(b) loans obtained from reputable financial institutions.

(2) Subject to paragraph (c) of subsection (2) of section 9, the Universal Access Development Fund established by section 13 shall be used to address the needs of the least advantaged communities in telecommunications.

(3) All moneys accruing to the Commission in the course of its operations, including licence fees, fines and other monetary sanctions imposed by the Commission shall be paid into the Consolidated Fund.

(4) The fees referred to in subsection (3) shall be fixed so as to ensure the recovery of the full cost of the work involved in the services for which the fees are charged and the realisation of the optimal commercial value for the facilities and opportunities provided thereby."
