The Mines and Minerals (Amendment) Act, 2004.

Being an Act to amend the Mines and Minerals Act, 1994.

[1st July, 2004]

Enacted by the President and Members of Parliament in this present Parliament assembled.

The Mines and Minerals Act, 1994 is hereby amended

(a) in section 118B, by the repeal and replacement of subsection (3) thereof with the following:—

"(3) Any person who contravenes subsection (1) or (2) commits an offence and is liable on conviction to
imprisonment for a term not less than three years".

(b) in section 118C—

i. by the repeal and replacement of subsection (3) thereof with the following:—

"(3) Any person who contravenes subsection (1) commits an offence and is liable on conviction to
imprisonment for a term not less than five years."

ii. by the insertion immediately after subsection (6) thereof of the following:—

"(7) A reward of forty percent of the net proceeds of the precious minerals in connection with which the
offence was committed shall be paid to any person who provided any information leading to the conviction
of the offender".
