SEIZED of the Motion of Issues of Urgent Concern to the Accused Morris Kallon filed on 1st October 2004 (“Motion”) by Defence Counsel for the Second Accused;

NOTING the Decision and Order on Prosecution Motion for Joinder and the Corrigendum thereto of 28th January 2004;

NOTING the Kallon – Decision on Motion for Quashing of Consolidated Indictment of 21st April 2004;

NOTING the Decision on Prosecutor Request for Leave to Amend the Indictment of 6th May 2004 and the Corrigendum and Consequential Order thereto of 12th May 2004;

NOTING the Scheduling Order for the Further Appearance of the Accused on the Amended Consolidated Indictment of 12th May 2004;

NOTING the Amended Consolidated Indictment filed by the Office of the Prosecutor (“Prosecution”) of 13th May 2004;

CONSIDERING the need for the Motion to be dealt with expeditiously;

CONSIDERING that a fair and expeditious consideration of the Motion necessitates the imposition of an expedited timetable for the filing of any remaining written submissions thereto;

PURSUANT to Rule 7(C) of the Rules;


HEREBY ORDERS as follows:

  1. Any Response to the Motion by the Prosecution shall be filed within three days from the receipt of the present Order; and consequently,
  2. Any Defence Reply to a response by the Prosecution shall be filed within two days from the receipt of such response.
