THE TRIAL CHAMBER (“Chamber”) of the Special Court for Sierra Leone (“Special Court”) composed of Hon. Judge Benjamin Mutanga Itoe, Presiding Judge, Hon. Judge Bankole Thompson and Hon. Judge Pierre Boutet;

NOTING the Materials Filed Pursuant to Order to the Prosecution to File Disclosure Materials and Other Materials in Preparation for the Commencement of Trial of 1 April 2004 (“Materials”), filed by the Prosecution on the 26th of April, 2004, that included an Exhibit List set forth in Coversheet 5 of the Materials;

NOTING that Exhibit Number 195 of the Exhibit List contained in the Materials, provides a map of Sierra Leone to scale 1 : 350,000;

NOTING that the Trial Chamber took judicial notice of the existence, authenticity and contents of the abovementioned map in its Decision on Prosecution’s Motion for Judicial Notice and Admission of Evidence, rendered on the 2nd of June, 2004;

CONSIDERING that it would benefit the trial proceedings if the Prosecution would highlight on this map all locations referred to in the Indictment, that include districts and towns within the territory of Sierra Leone;

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence of the Special Court;

ORDERS AS FOLLOWS:

  1. That the Prosecution highlight on the map, to a readable scale, all locations referred to in the Consolidated Indictment, that include districts and towns within the territory of Sierra Leone, and submit this copy to the Trial Chamber and to the Defence; and
  2. That the Prosecution submit additional maps to the Trial Chamber and the Defence Teams that highlight all locations referred to in each specific count of the Consolidated Indictment, that include districts and towns within the territory of Sierra Leone. Separate maps should be submitted for the following areas of the Consolidated Indictment:
    • (a) Paragraphs 23 to 24;
    • (b) Counts 1-2;
    • (c) Counts 3-4;
    • (d) Count 5;
    • (e) Counts 6-7;
  3. That the Prosecution submit all highlighted maps to the Trial Chamber and the parties by Tuesday the 2nd of November, 2004 and seek to have these maps admitted into evidence as exhibits;
  4. That the Defence file their responses, if any, on the issue of admissibility of the maps by the 9th of November, 2004.
