THE TRIAL CHAMBER (“Chamber”) of the Special Court for Sierra Leone (“Special Court”) composed of Hon. Judge Benjamin Mutanga Itoe, Presiding Judge, Hon. Judge Bankole Thompson and Hon. Judge Pierre Boutet;
NOTING the Decision on Prosecution’s Motion for Judicial Notice and Admission of Evidence dated the 24th of June 2004, in which this Chamber took judicial notice as to the existence, authenticity and contents of a map of Sierra Leone;[1]
CONSIDERING that it would benefit the trial proceedings if the Prosecution would highlight on this map all locations referred to in the Amended Consolidated Indictment, that include districts and towns within the territory of Sierra Leone;
PURSUANT TO Rule 54 of the Rules of Procedure and Evidence of the Special Court;
ORDERS AS FOLLOWS:
- That the Prosecution highlight on the map, to a readable scale, all locations referred to in the Amended Consolidated Indictment, that include districts and towns within the territory of Sierra Leone, and submit this copy to the Trial Chamber and to the Defence; and
- That
the Prosecution submit additional maps to the Trial Chamber and the Defence
Teams that highlight all locations referred to in
each specific count of the
Amended Consolidated Indictment, that include districts and towns within the
territory of Sierra Leone.
Separate maps should be submitted for the following
areas of the Amended Consolidated Indictment:
- (a) Counts 3-5;
- (b) Count 6-9;
- (c) Counts 10-11;
- (d) Count 13; and
- (e) Count 14.
- That
the Prosecution submit all highlighted maps to the Trial Chamber and the Defence
by the 5th of November 2004, and move the Trial Chamber
to admit these maps as exhibits into evidence; and
- That
the Defence file their responses, if any, on the issue of admissibility of the
exhibited maps by the 12th of November 2004.
