SEIZED of the Request for Leave to File an Amended Indictment filed by the Office of the Prosecutor (“the Prosecution”) on 9 February 2004 (“Motion”) pursuant to Rules 50(A) and 73(A) of the Rules of Procedure and Evidence of the Special Court (“Rules”);

NOTING the responses to the Motion filed on behalf of Augustine Gbao and Issa Sesay, both filed on 19 February 2004 (“Defence Responses”);
