TRIAL CHAMBER II (“Trial Chamber”) of the Special Court for Sierra Leone (“Special Court”), composed of Justice Richard Lussick, presiding, Justice Teresa Doherty and Justice Julia Sebutinde;

SEISED of the Urgent Prosecution Motion on Witness Call Order, filed on 22 May 2006 (“Motion”), in which the Prosecution seeks an order that identifying data for the first 10 Defence witnesses scheduled to testify in their correct order of call be disclosed by 4pm on Monday 22 May at the latest;

RECALLING the Trial Chamber’s Order on Urgent Prosecution Motion on Witness Call Order and Scheduling Order, dated 22 May 2006, allowing any response to the Motion to be filed on or before 4pm on Tuesday, 23 May 2006, any reply to the response to be filed on or before 4pm on Wednesday, 24 May 2006, and scheduling a status conference for Thursday 25 May 2006, at 11am;

NOTING the Confidential Joint Defence Response to Urgent Prosecution Motion on Witness Order and Defence Witness Order of First Seventeen Witnesses and Their Identifying Data, filed on 22 May 2006 (“Response”), in which the Defence provides the identifying data and order of call of the first 17 Defence witnesses;

NOTING the Confidential Joint Defence Disclosure of Summary Witness DBK-094, filed on 23 May 2006, providing a summary of the evidence to be given by Witness DBK-094, who has been added to the witness list;

NOTING that the Prosecution has not filed a reply to the Response;

CONSIDERING that the relief sought by the Prosecution in its Motion has been made redundant by the Response;


HEREBY DISMISSES THE MOTION.
