TRIAL CHAMBER II (“Trial Chamber”) of the Special Court for Sierra Leone (“Special Court”), composed of Justice Teresa Doherty, presiding, Justice Richard Lussick and Justice Julia Sebutinde;

SEISED of the Prosecution’s Motion for Judicial Notice and Admission of Evidence (“the Motion”), filed on 2 April 2004;

NOTING the recent decision of the Appeals Chamber “Decision on the Appeal Against Decision on the Prosecution’s Motion for Judicial Notice and Admission of Evidence” dated 16 May 2005 in the proceedings against Moinina Fofana in Case No SCSL-04-14 before the Special Court;

NOTING that the submissions of the Prosecution predate the Appeals Chamber ruling and that they may reconsider their submissions in light of this recent decision;

NOTING FURTHER that all Defence for the Accused have not responded to the Motion;

CONSIDERING that it would assist the Trial Chamber to have further submissions in light of the recent Appeals Chamber decision on the interpretation and application of Rule 94;

HEREBY ORDERS that:

  1. The Prosecution files a consequential submission by 4:00 p.m. on 6 June 2005;
  2. The Defence file a Response thereto by 4:00 p.m. on 10 June 2005;
  3. The Prosecution file a Reply – if any – by 4:00 p.m. by 13 June 2005.
