TRIAL CHAMBER I (“Trial Chamber I”) of the Special Court for Sierra Leone (“Special Court”) composed of Hon. Justice Benjamin Mutanga Itoe, Presiding Judge, Hon. Justice Pierre Boutet and Hon. Justice Bankole Thompson;
CONSIDERING the provisions of and PURSUANT to Article 17 of the Statute of the Special Court for Sierra Leone (“Statute”) and of Rules 54, 66, 67 and 70 of the Rules of Procedure and Evidence (“Rules”);
NOTING that the Defence during examination or cross-examining Defence witnesses, refer to the evidence led by Prosecution witnesses during the Prosecution case, and in so doing, they do not readily avail the Trial Chamber or its Legal Officers and/or other parties such statements relied up on;
MINDFUL that to ensure an orderly process and for the expeditiousness of the trials it is in the interest of justice that Defence Counsel before they proceed with their examination of a particular witness make available materials they intend to rely on or cross-examine on to the Trial Chamber through their Legal Officers and to the other parties;
FOR THE FOREGOING REASONS,
THE TRIAL CHAMBER, ORDERS and INSTRUCTS all Defence Counsel to take all the necessary measures to give effect to this Decision of the Trial Chamber by ensuring that they disclose all the materials, document, exhibits or statements they intend to rely on in their examination-in-chief or cross-examination of witnesses so that the trial could proceed in an orderly manner and without any unnecessary delay.
