HON. JUSTICE BENJAMIN MUTANGA ITOE, PRESIDING JUDGE, AND HON. JUSTICE PIERRE BOUTET of Trial Chamber I (“Trial Chamber”) of the Special Court for Sierra Leone (“Special Court”);
HAVING RECEIVED the Motion for Voluntary Withdrawal or Disqualification of Justice Bankole Thompson from the RUF Case, filed jointly by Counsel for the First Accused, Issa Hassan Sesay, and Court Appointed Counsel for the Third Accused, Augustine Gbao (“Defence”) on the 14th of November 2007 (“Motion”);
RECALLING the Chamber’s Order for Expedited Filing, filed on the 16th of November 2007;
NOTING the Statement in Support of the Sesay and Gbao Joint Motion for Voluntary Withdrawal or Disqualification of Justice Bankole Thompson from the RUF Case filed on the 14th day of November 2007, filed by Counsel for the Second Accused, Morris Kallon, on the 20th of November 2007;
HAVING RECEIVED the Response to the Motion filed by the Office of the Prosecutor (“Prosecution”) on the 20th of November 2007 and the Reply thereto, filed jointly by the Sesay and Gbao Defence on the 21st of November 2007;
RECALLING the statement made by the Presiding Judge, Hon. Justice Benjamin Mutanga Itoe, in on the 20th of November 2007 that the trial would be adjourned until a date to be announced in due course;[1]
RECALLING that pursuant to Rule 16(A) of the Rules of Procedure and
Evidence of the Special Court for Sierra Leone (“Rules”), Hon.
Justice Benjamin Mutanga Itoe and Hon. Justice Pierre Boutet may sit in the
absence of Hon. Justice Bankole Thompson for up to five
days;
PURSUANT TO
Rule 54 and Rule 65bis of the Rules;
IN THE INTERESTS OF JUSTICE, HEREBY ORDERS AS FOLLOWS:
- that the trial will resume on Thursday, the 22nd of November 2007 at 9:30 a.m. and continue on Friday, the 23rd of November, Monday, the 26th of November and Tuesday, the 27th of November 2007;
- that all examination-in-chief and cross-examination by the parties shall conclude by 1:00 p.m. on Tuesday, the 27th of November 2007;
- that a Status Conference will be held on Tuesday, the 27th of November 2007 at 3:00 p.m.;
- that
the trial session will be adjourned from Wednesday, the
28th of November 2007 until a Decision has been
rendered on the Motion
