TRIAL CHAMBER I (“The Chamber”) of the Special Court for Sierra Leone (“Special Court”) composed of Hon. Justice Bankole Thompson, Presiding Judge, Hon. Justice Benjamin Mutanga Itoe and Hon. Justice Pierre Boutet;

SEIZED OF the “Application by First Accused for Leave to Make Interlocutory Appeal Against the Decision on Motions by Moinina Fofana and Sam Hinga Norman for the Issuance of a Subpoena Ad Testificandum to H.E. Alhaji Dr. Ahmad Tejan Kabbah, President of the Republic of Sierra Leone”, filed by Court Appointed Counsel for the First Accused on the 19th of June 2006 (“Norman Motion”);

SEIZED OF the “Urgent Fofana Application for Leave to Appeal the Subpoena Decision”, filed by Court Appointed Counsel for the Second Accused on the 19th of June 2006 (“Fofana Motion”);

CONSIDERING that Article 17(4)(c) of the Statute of the Special Court provides that the Accused shall be “tried without undue delay”;

CONSIDERING that the Special Court will observe judicial recess from the 7th until the 18th of August 2006, during which period the Court Management Section of the Registry will not accept any documents for filing;[1]

CONSIDERING that the eighth trial session in this case is scheduled to run from the 13th of September 2006 until the 7th of December 2006 with a preceding Status Conference on the 12th of September 2006;[2]

CONSIDERING that the fair and expeditious consideration of the Motion requires the imposition of an expedited timetable for the filing of any remaining written submissions;[3]

PURSUANT to Rule 7(C), 26bis, 54 and 73 of the Rules of Procedure and Evidence of the Special Court;


HEREBY ORDERS as follows:


  1. The Prosecution shall file a consolidated Response to the Norman Motion and Fofana Motion, if any, no later than Thursday, the 22nd of June 2006, at 4:00 p.m.;
  2. Court Appointed Counsel for the First Accused and by Court Appointed Counsel for the Second Accused shall file their respective Replies, if any, no later than Monday, the 26th of June 2006, at 4:00 p.m.;
