THE APPEALS CHAMBER OF THE SPECIAL COURT FOR SIERRA LEONE;
NOTING the Scheduling Orders in cases SCSL-03-01 and SCSL-04-14 by the Appeals Chamber of 11 May 2004 (“Orders”);
NOTING that the hearing for the Applicant’s Motion against the unwholesome and bias comments made by the President and Presiding Judge of the Appeals Chamber of the Special Court for Sierra Leone Geoffrey Robertson Q.C. when he described ex-president Charles Ghankay Taylor the Applicant herein as a vicious Warlord at page 466 of his book entitled Crimes Against Humanity – the Struggle for Global Justice under the Subtitle – Lessons from Sierra Leone starting from page 465 onwards as well as on other two Grounds which go to Jurisdiction and/or Excess of Jurisdiction (“Taylor Motion”), filed 28 January 2004, was scheduled for Tuesday, 25 May 2004, at 14.30;
NOTING that the hearing for the Motion to Recuse Judge Winter from deliberating in the preliminary motion on the recruitment of child soldiers (“Norman Motion”), filed 25 March 2004, was scheduled for Tuesday, 25 May 2004, at 10.30;
NOTING the Motion Seeking Clarification of the Decision on Defence Motion Seeking the Disqualification of Justice Robertson from the Appeals Chamber, filed 20 April 2004 (“Sesay Motion”);
DECIDING that pursuant to Rule 117(A) of the Rules of Procedure and Evidence the Chamber will determine the Sesay Motion entirely on the basis of written submissions;
HEREBY ORDERS that
- the oral hearing in the Taylor Motion be rescheduled to Tuesday 25 May 2004 at 10.30am;
- the oral hearing in the Norman Motion be rescheduled to Tuesday 25 May 2004 at 14.30pm; and
- the Sesay Motion be scheduled for Tuesday 25 May 2004 at 10.00am for the rendering of the decision.
